KINGDOM BJJ PARTICIPATION WAIVER, ASSUMPTION OF RISK & RELEASE OF LIABILITY IMPORTANT NOTICE
This Agreement affects your legal rights, including your right to bring legal action in certain circumstances. Please read this document carefully before signing. By signing below, you acknowledge that you have read, understood, and voluntarily agree to the terms of this Agreement.
This Agreement is binding upon me, my heirs, executors, administrators, legal representatives, and assigns. By signing below, I confirm that I have carefully read and understood this Agreement, have had the opportunity to ask questions, understand that I am giving up certain legal rights, and voluntarily agree to be bound by its terms.
1. Acknowledgement & Assumption of Risk
I understand that Brazilian Jiu-Jitsu and the activities offered by Kingdom BJJ are physically demanding contact sports involving inherent risks that cannot be eliminated regardless of the level of instruction, supervision, or safety precautions. These activities may include, but are not limited to, takedowns, throws, falls, sweeps, joint locks, chokeholds, live sparring, positional training, drilling, strength and conditioning, competitions, seminars, private lessons, open mats, and close physical contact with other participants. I acknowledge that participation may result in injuries including, but not limited to, bruises, cuts, sprains, strains, fractures, dislocations, torn muscles or ligaments, concussion, spinal injury, illness, permanent disability, or death. I understand that injuries may occur despite proper coaching, supervision, or the exercise of reasonable care by Kingdom, its instructors, staff, volunteers, or other participants. I knowingly and voluntarily assume all risks associated with my participation and freely choose to participate. 2. Participant Responsibilities & Medical
Acknowledgement I confirm that I am physically able to participate in Kingdom’s activities or have consulted with an appropriate medical professional regarding my participation. I understand that I am responsible for monitoring my own physical condition and will immediately stop training and notify an instructor if I become injured, ill, or otherwise unable to participate safely. I agree that I will not participate while suffering from a contagious illness or communicable skin condition and will maintain appropriate personal hygiene, including clean training attire and trimmed fingernails and toenails. While participating at Kingdom, I agree to: Follow all instructions given by instructors and staff. Train with control, respect, and consideration for my training partners. Tap when necessary and immediately release any submission upon my partner’s tap or verbal submission. Remove all jewelry before training. Promptly report any injury, unsafe condition, or unsafe conduct to an instructor. I understand that Kingdom reserves the right to refuse or discontinue my participation where my health, conduct, or the safety of others may be compromised. 5. Photography & Video Recording
I understand and acknowledge that photographs, video recordings, and other media may be captured during classes, open mats, seminars, competitions, and other activities at Kingdom. These recordings may be created by Kingdom, its staff, or authorized representatives for instructional, promotional, marketing, archival, or community purposes. By participating in Kingdom activities, I grant Kingdom permission to use my name, image, likeness, voice, and appearance in photographs, videos, and other media on its website, social media platforms, printed materials, advertisements, and other promotional or educational content without compensation or further notice. I acknowledge that, due to the nature of group training, it is not practical for Kingdom to prevent me from appearing incidentally in photographs or recordings captured during normal academy activities, and I release Kingdom from any claims arising from such authorized use.
4. Release of Liability & Indemnity
To the fullest extent permitted by the laws of Ontario, I release, waive, and forever discharge Kingdom BJJ, its owners, instructors, coaches, employees, volunteers, contractors, affiliates, landlords, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses arising from or relating to my participation in Kingdom activities, including claims arising from the ordinary negligence of the Released Parties. I further agree to indemnify and hold harmless the Released Parties from any claims, damages, or liabilities arising from my own negligent, reckless, or intentional actions while participating in Kingdom activities, to the extent permitted by law. Nothing in this Agreement is intended to exclude liability where such exclusion is prohibited by applicable law.
3. Emergency Medical Authorization
In the event of an injury or medical emergency, I authorize Kingdom to contact emergency medical services and my designated emergency contact if Kingdom reasonably believes such action is necessary. I understand that I am solely responsible for any medical expenses arising from my participation.
6. General Terms
This Agreement shall be governed by the laws of the Province of Ontario and the applicable laws of Canada. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. This Agreement is binding upon me, my heirs, executors, administrators, legal representatives, and assigns. By signing below, I confirm that I have carefully read and understood this Agreement, have had the opportunity to ask questions, understand that I am giving up certain legal rights, and voluntarily agree to be bound by its terms.
